There is no safe one-document shortcut. A cédula, immigration card or RUC should not be presented as automatic proof that another country must stop treating you as tax resident.

For planning purposes, treat these as separate layers. A person may obtain immigration residence and a cédula without immediately becoming active under every Paraguayan tax regime. Conversely, a person carrying out taxable activity in Paraguay may have registration obligations even before obtaining the tax certificate they want for treaty or banking purposes.

Does Paraguay use territorial taxation?

Yes, but the term “territorial” is often oversimplified online.

For the Personal Income Tax, Law 6380 states that Paraguayan-source income is taxable. The law focuses on activities developed in Paraguay, property located in Paraguay and rights economically used in Paraguay.

This means the location of the customer, bank account or payment processor is not always decisive. The legal source of the income must be analysed.

“Paid from abroad” does not automatically mean “foreign-source.” A service physically performed from Paraguay can constitute Paraguayan-source income even when the client is foreign and payment arrives in a foreign account.

What can count as Paraguayan-source income?

Work physically performed in Paraguay

Employment, professional or independent services carried out from Paraguayan territory can fall within the territorial source rule.

Property and rights in Paraguay

Income connected to property located or rights economically used in Paraguay can be Paraguayan-source.

Certain work performed abroad

Law 6380 also treats some services performed outside Paraguay as Paraguayan-source where the service is provided to an IRE or IRP taxpayer.

Investment and capital income

The treatment varies by asset, location, issuer, taxpayer category and the detailed source rules. It should not be reduced to a blanket “all foreign investments are exempt” statement.

The correct question is not only “Where is the client?” It is also where the activity is performed, where the asset is located, where the right is used and which statutory source rule applies.

Remote work for foreign clients

Remote workers should be especially cautious with claims that foreign-client income is automatically outside Paraguay.

In a published tax consultation, the administration explained that services physically performed outside Paraguay were not subject to IRP under the territorial rule, while the portion performed from Paraguay for foreign clients was treated as Paraguayan-source.

Working from Paraguay

The service may be Paraguayan-source even if the client, contract and payment account are abroad.

Working physically abroad

The foreign-performed portion may fall outside IRP, subject to the statutory exceptions and complete facts.

Hybrid work

Income may need to be allocated according to where the work was actually performed.

Remote-work taxation is fact-sensitive. Keep travel, contract, invoice and work-location records rather than relying on the payer’s country alone.

Paraguay tax residence certificate

DNIT can issue a Certificate of Tax Residence for a specified fiscal period or year.

Resolution 65/2020 states that a natural person, legal person or legal structure may request a document certifying whether the applicant is subject to Paraguayan tax rules for the stated period.

What it is used for

It can be used for tax purposes, including the application of a double-tax treaty where relevant.

How long it is valid

The certificate is valid for one year from its issuance, according to Resolution 65/2020.

The certificate concerns a stated period. It is not merely a generic letter confirming that the applicant once received immigration residence.

Resolution 65/2020 provides that the administration should issue the certificate within ten business days after a complete application is submitted and accepted. Incomplete or non-compliant requests may be rejected and resubmitted after correction.

Double-tax treaties

Tax treaties can override or coordinate parts of domestic law, but only when a treaty is actually in force and the person qualifies for its benefits.

A treaty analysis may examine permanent home, centre of vital interests, habitual abode, nationality or other tie-breaker criteria. The precise test depends on the treaty text.

Do not assume Paraguay has a treaty with every country. Where no treaty applies, each country may apply its own domestic residence and source rules, creating possible overlap.

Banking, self-certification and CRS

Banks can ask for tax-residence self-certifications, tax identification numbers and documentary evidence.

A bank’s onboarding decision is not the same as a binding tax ruling. Providing a Paraguayan RUC or cédula does not erase possible reporting obligations linked to another country.

Keep your declarations consistent

Your bank forms, migration movements, tax filings, address records and treaty claims should not contradict one another.

Review former-country rules

Some countries use days, permanent home, centre of interests, domicile or departure procedures when deciding whether tax residence has ended.

Obtain the Paraguayan cédula

The valid identity card is part of the published certificate procedure.

Map all income streams

Separate employment, consulting, business, rent, dividends, interest, capital gains and pensions.

Determine the source of each income stream

Analyse where work is performed, assets are located and rights are economically used.

Register the correct RUC obligations

Activate only the obligations that match the actual activity, with professional advice where needed.

Maintain tax compliance

File required returns, document exempt or non-taxable transactions correctly and keep records.

Obtain migration-movement evidence

Natural-person certificate requests require the relevant movement record.

Request the DNIT certificate

Apply for the fiscal period needed for treaty, banking or administrative purposes.

Review your former country

Complete any departure filings and verify whether domestic or treaty tests still treat you as resident there.

Does a Paraguayan cédula prove tax residence?
